FS 240.209 Board of Regents; Powers and Duties

Gives the Board authority to adopt rules and policies related to the financial and physical development of the system, and to monitor the fiscal performance of the universities.

Requires the Board to prepare legislative budget requests, including fixed capital outlay requests, and provide to the individual universities fiscal policy guidelines, formats, and instructions for the development of individual university budget requests.

Requires the Board by December 1, to set the tuition policy for the subsequent fall term. In the absence of legislative action, the fees shall go into effect. When the appropriations act requires a different fee schedule, the Board establishes a fees schedule to produce the total fee revenue provided in the appropriations act based on planned enrollment.

Authorizes the Board to collect for financial aid purposes an amount not to exceed 5 percent of the student tuition and matriculation fee per credit hour. A minimum of 50 percent is to be used for need base students.

 

FS 216.023 Legislative Budget Request to be Furnished by Agencies

Directs the Board to submit a final legislative budget request based on the Board’s independent judgement of its needs.

FS 240.2094 State University System Management Flexibility

Provides that the funds for the operation of the State University System are to be requested and appropriated within budget entities, program components, program categories, lump sums, or special categories. Allows the Board of Regents to provide each university an approved budget based upon the appropriations act, and the universities to develop an annual operating budget that allocates funds by program component and traditional expenditure category.

Authorizes the Board of Regents to manage its appropriations, through the Office of the State Comptroller.

Authorizes the Board of Regents to establish the authorized positions and initial approved salary rate and to amend such positions and rate, within salary rate authorized annually in the appropriations act.

FS 240.271 State University System; funding 

Establishes that planned enrollments for each university as accepted or modified by the Legislature and categorical programs not directly related to planned student enrollment are to be the basis for the allocation of appropriated funds to the universities.

Requires the Board of Regents to establish and validate an Expenditure Analysis and report as part of its legislative budget request the actual expenditures for the fiscal year ending the previous June 30.

Requires that enrollment planning plus program cost data established by this section shall be used as the basis for preparing the legislative budget requests.

 

FS 240.277 Additional Appropriation

Authorizes the Board of Regents, in consultation with the appropriations committees of the Legislature, to approve an estimated level of expenditures, salary rates, and positions for the Auxiliary Enterprises and Contracts and Grants budget entities, and the self-insurance programs.

 

FS 240.272 Carryforward of Unexpended Funds

Allows up to 5% of any appropriated funds which are, unexpended at the end of the fiscal year to be carried forward by the Board of Regents for use by the university to which the funds were allocated.

These funds may be expended for major equipment purchases; for scientific, technical, or other equipment; for matching challenge grant programs; for library resources; for minor repairs, renovations, or maintenance; for major studies or planning processes; for maintaining access to course offerings in the event of a revenue shortfall; or for expanding access to course offerings, as approved by the Board of Regents.

 

Section 216.0158 Assessment of Facility Needs

Requires each state agency to submit to the Governor a five-year plan that addresses its facility needs on a project-by-project basis. Agency plans are used by the Governor to prepare a comprehensive state plan.

 

Section 235.15 Educational Plant Survey

Provides that the Board of Regents must arrange for an educational plant survey at least every five years. The purpose of the survey is to aid in formulating plans for housing the educational program and student population, faculty, staff, and auxiliary and ancillary services of the campus, including consideration of the local comprehensive plan. The survey report shall include at least an inventory of facilities, recommendations relating to existing facilities, recommendations for any additional facilities, and the general location of each new facility in relation to the master plan.

 

Section 235.41 Legislative Capital Outlay Budget Request

Outlines the requirements with which the Commissioner of Education must comply in the preparation of a fixed capital outlay budget for the three educational delivery systems (i.e., Public Schools, Community Colleges, and State University System). This section requires the Commissioner to allocate funds to the Community Colleges and to the Board of Regents for use in developing their respective three-year priority lists.

 

Section 235.42 Educational and Ancillary Plant Construction Funds; Public Education Capital Outlay and Debt Service Trust Fund; allocation of funds.

 

Requires the Commissioner of Education to administer the PECO Debt Service Trust fund for all units of education. Generally, the Commissioner is required to ensure that funds necessary to carry out the legislative appropriations are available when needed by the school districts, community colleges, and universities.

 

Section 235.4235 Financing of Approved Capital Projects (PECO)

Provides that PECO projects may be supplemented from grants, donations, and matching funds from other sources. Also identifies restrictions for transfers between appropriations.

 

Section 235.435 Funds for Comprehensive Educational Plant Needs.

Identifies the types or purposes of PECO appropriations available to school boards, community college boards, and the Board of Regents. The Board of Regents receives two regular appropriations - one for remodeling, renovation, maintenance, repair and site improvements for existing satisfactory facilities and one for the Three-Year PECO Project Priority List that may be expended for site acquisition, site improvements, renovation/remodeling of existing facilities, and construction of additional facilities. This statute also specifies the method for distribution of appropriation amounts for remodeling, renovation, maintenance, repair, and site improvements between the three delivery systems and the eligibility requirements for projects on the Three-Year PECO Project Priority List (must be recommended in an educational plant survey and an approved building program must be on file). The specified formula for distribution of remodeling/renovation funds is based primarily on building replacement value and building age. Funds available for the Three-Year PECO Project Priority List are distributed between the three divisions based on their respective percentage of PECO appropriations for the preceding five years.

 

Section 240.156 SUS Concurrency Trust Fund.

Provides for use of a portion of local option motor vehicle fuel tax collections for offsite improvements to meet concurrency standards.

 

Section 240.2601 SUS Facility Enhancement Challenge Grant "Courtelis Program" Program.

Establishes the state-matching program for instructional and research facilities. Under this program, a private contribution to construct a facility will be matched by the state from non-PECO sources. To qualify for the program, the project for which private funds were raised must be in the Five-Year Capital Improvements Plan.

 

Section 240.2805 Administration of Capital Improvement and Building Fees Trust Funds

Provides that the Board of Regents shall administer these trust fund revenues and restricts the use of funds not required for debt service or educational research centers for child development for projects appropriated by the Legislature. Further provides that projects appropriated by the Legislature from this fund source may be expanded with supplemental funding from grants, auxiliary enterprise revenues, private donations, and other nonstate sources.

 

Section 240.295 SUS Buildings; approval of construction.

Authorizes the Board of Regents to construct projects that are funded from non-state sources such as federal grants, private gifts, student housing, and other auxiliary accommodations.
